This policy describes how we collect, process, retain, and disclose personal data about you when providing services to you through our websites, applications, products, and services that link to this policy (our “Services“) and our practices for using, maintaining, protecting, and disclosing that information.
This policy applies only to information we collect:
- Through the Services.
- In communications, including email, text, chat, and other electronic messages, between you and the Services.
- When you interact with our advertising and applications (including mobile apps) on third-party websites and services, if those applications or advertising include links to this policy.
It does not apply to information collected by:
- Us offline or through any other means, including on any other website operated by Company or any third party that does not link to this policy; or
- Any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services.
We may provide additional or different privacy policies that are specific to certain features, services, or activities.

By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. Children’s and Minors’ Data
Our website is not intended for nor does it knowingly collect any personal data from, children under the age of 18. If we learn our website has collected or received personal data from a child under 18 years old without verification of parental consent, we will delete that information. - Account and contact information, including email address, phone number, username, and other contact information you provide us.
- Account history, including information about your subscription, account, transactions, purchases, order history, or discounts.
- Demographic information, including your age or gender.
- While our Application allows users to create and save videos locally on their device of themselves our Application does not receive, transmit, or store any video data.
- Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
- Content and information you elect to provide as part of your profile or in any reviews you make through the Services or emails, chats, or other communications sent to us.
- Images, voice recordings, and videos collected or stored in connection with the Services, if you have consented to such information collection.
Some of the information identified above may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.
We also collect:
- Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific Services feature.
- Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

You Provide Information to Us
We collect information about you when you interact with our Services, such as when you create or update an account, subscribe, or make a request, or create, upload, or post content to the Services, including reviews, media such as photos, videos, or audio recordings.
Automatically Through Our Services
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, location data, logs, and other communication data, and which resources and Services features that you access and use.
Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.
The technologies we use for this automatic data collection may include:
- A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.

Please note that some Services features may be unavailable as a result.

- Advertisers, ad networks, and ad servers.

- Your internet or mobile service provider.
These third parties may use tracking technologies to collect information about you when you use the Services. - To fulfill the purpose for which you provide it. For example, if you give us an email address to use an “email a friend” feature of our Services, we will transmit the contents of that email and your email address to the recipients.

Your Rights and Choices About Your Information

Advertising, marketing, cookies, and other tracking technologies choices:
- Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Services to collect information through other tracking technologies by e-mailing us at privacy@blue5basketball.com. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. - Promotions by the Company. If you do not wish us to use your information to promote our own or third parties’ products or services, you can opt out by or sending us an email stating your request privacy@blue5basketball.com.
Location data choices:
- Location Data. You can choose whether or not to allow the Services to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some Services features may become inaccessible or not function properly.
Your State Privacy Rights
Depending on your state of residency, you may have certain rights related to your personal data, including:
- Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
- You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.
- You may request that we delete personal data about you that we maintain, subject to certain exception under applicable law.
- Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. You may request that we do not use your personal data for these purposes.
Important: The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request.

If we deny your request, we will notify you and provide our reasons for the denial and instructions regarding the rights you may have under applicable laws to appeal the decision. If the appeal is denied, we will notify you of your rights under applicable laws to contact the Attorney General to submit a complaint.
Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.
How We Protect Your Personal Data
We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.
The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access.
How We Retain Your Personal Data
We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.

Privacy Policy for Children Under the Age of 13

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this section, “parents“) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children“). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information.
This section notifies parents of:
- The types of information we may collect from children.
- How we use the information we collect.
- Our practices for disclosing that information, including specific information about third parties.
- Our practices for notifying and obtaining parents’ consent when we collect personal information from children, including how a parent may revoke consent.
- All operators that collect or maintain information from children through this Blue 5 Basketball, LLC.
This section only applies to children under the age of 13 and supplements the other provisions of this privacy policy. Only the other provisions of this privacy policy apply to teens and adults.
Terms that are defined in the general privacy policy have the same meanings as used in this Privacy Policy for Children Under the Age of 13.
Information We Collect from Children
Use of the features of the Application requires children to provide us with certain personal information. Further, some content and features may involve collecting certain additional information, including personal information, from them. In addition, we use certain technologies, such as cookies or Application usage data, to automatically collect information from our users (including children) when they visit or use the App.
We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.
Information We Collect Directly
A child must provide us with the following information to register with the App: the child’s birth date, and a parent’s email address and/or phone number. We also require the child to create a member name and password. We may request additional information from your child, but this information is optional, this may include but is not limited to video uploads for children to demonstrate completion of certain challenges. Children are not required to make any video uploads to use the Application, but they may not be able to participate in certain challenges if they do not. We do not retain video uploads; however, we may contact you directly to ask permission to use such video uploads for marketing purposes and use on our social media. We will not use such uploads or retain it without your permission. We specify whether information is required or optional when we request it.
We may use persistent identifiers to support internal operations, including Application performance and usage information. We ensure that persistent identifiers are not used or disclosed to contact an individual, to create a profile, or for any other purpose, except as permitted under COPPA to provide support for the internal operations of the App.
Automatic Information Collection and Tracking
We use technology to automatically collect information from our users, including children, when they access and navigate through the Application and use certain of its features. The information we collect through these technologies may include:
- One or more persistent identifiers that can be used to recognize a user over time and across different websites and online services.
- Information that identifies a device’s location (geolocation information).
- Biometric identifiers that can be used for the automated or semi-automated recognition of an individual.
We may combine non-personal information we collect through these technologies with personal information about you or your child that we collect online.
For information about our automatic information collection practices, including how you can opt out of certain information collection, see the “Automatic Information Collection and Tracking” and “Choices About How We Use and Disclose Your Information” sections of our Privacy Policy.
How We Use Your Child’s Information
We use the personal information we collect from your child to:
- register him or her with the App;
- communicate with him or her about activities or features of the Application that may be of interest; and
- track his or her performance in games or other activities in the App;
We use the information we collect automatically through technology (see Automatic Information Collection and Tracking) and other non-personal information we collect to improve our Application and to deliver a better and more personalized experience by enabling us to:
- Estimate our audience size and usage patterns.
- Store information about the child’s preferences, allowing us to customize the content according to individual interests.
- Speed up your child’s searches.
Our Practices for Disclosing Children’s Information
We do not share, sell, rent, or transfer children’s personal information other than as described in this section.
We may disclose aggregated information about many of our users, and information that does not identify any individual or device. In addition, we may disclose children’s personal information:
- To third parties we use to support the internal operations of our Application and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential.
- If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Blue 5 Basketball, LLC, our customers or others, including to:
- protect the safety of a child;
- protect the safety and security of the App; or
- enable us to take precautions against liability.
- To law enforcement agencies or for an investigation related to public safety.
If Blue 5 Basketball, LLC is involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Blue 5 Basketball’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the personal information we have collected or maintain to the buyer or other successor.
Social Features
The Application offers social features, including the ability to join groups for competition against other users. The Application does not allow instant messaging, chat, email, posting on message boards, or any other features that enable children to communicate with others through the App. We do not control which competition groups a child can joint, but we encourage parents to educate their children about safety online and to carefully monitor their children’s use of the App’s social features.
Accessing and Correcting Your Child’s Personal Information
At any time, you may review the child’s personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child’s information.
You can review, change, or delete your child’s personal information by: Sending us an email at privacy@blue5basketball.com. To protect your privacy and security, we may require you to take certain steps or provide additional information to verify your identity before we provide any information or make corrections.
Operators That Collect or Maintain Information from Children
No other third-party operators may collect or maintain personal information from children through the App.
